DojoCode Terms of Service

Welcome to DojoCode!

DojoCode is a platform for learning and practising software development, available at dojocode.io and other DojoCode co-branded websites. It lets you solve and create coding challenges, follow learning paths, take part in contests and hackathons, build and publish projects, work with an AI assistant, collaborate live with other people, and take part in classes and training run by a school or organization (the “Service”).

The Service is provided to you by DojoCode.

Your relationship with us

This document and any documents referred to within it (collectively, the “Terms of Service”) explain the terms of your relationship with us. It is important that you read and understand these Terms of Service before using the Service. If there is anything within them that you do not understand, then please do not hesitate to contact us to discuss what this means for you.

By using and accessing the Service you agree to these Terms of Service. If you do not agree to these Terms of Service, please do not access or use the Service.

If you use the Service on behalf of a school, university or company, or you manage an organization account, our Terms of Service for organizations also apply to you. If there is a conflict between the two documents about your use of an organization account, the Terms of Service for organizations apply.

Information about us

DojoCode is incorporated and registered in Romania, under the company name DOJOCODE SRL. Our registered office is at Str. Tarnavei 9 Bl. 62 Ap. 21, Satu-Mare, Romania.

Information about you

Your privacy is important to us. You should read our Privacy Policy to understand how we collect, use and share information about you. Your rights with respect to your personal information are described therein.

We may transfer and store your information in a jurisdiction outside the European Union. Our Privacy Policy explains the safeguards we use when we do.

Your account

You need an account to use most of the Service. You must give accurate information when you create it, keep your sign-in details secret, and tell us if you believe someone else has used your account. You are responsible for what happens under your account.

Your account is personal to you. You may sign in with a third-party service such as GitHub, Google or Discord, in which case that service's own terms also apply to your use of it.

If you are under 16, you may use the Service only through a school or organization that has obtained any consent required by law, for example from your parent or guardian.

Your right to use the Service

You are permitted to access and use the Service to learn, practise, take part in the activities we make available, and build your own projects, in accordance with these Terms of Service.

Your right to use the Service is personal to you. Your right to use the Service does not stop us from giving other people the right to use the Service.

Please note that the materials and content comprising the Service either belong to or are licensed to us and we give you permission to use these materials and content for the sole purpose of using the Service in accordance with these Terms of Service.

Using DojoCode through a school or organization

If you join a group created by a teacher, or you are a member of an organization on DojoCode, the teachers and administrators of that group or organization can assign work to you, see your solutions, progress and results for that work, decide how much AI help is available to you, and add you to or remove you from the group. Features that you receive through the organization, such as premium access, last for as long as you are a member of it and the organization keeps its plan.

Paid plans

Some features of the Service require a paid subscription, such as DojoCode Premium. The price, the billing period and what the plan includes are shown on our pricing page before you buy.

• Payment. Payments are processed by Stripe. Taxes are calculated at checkout from your billing address.
• Renewal. A subscription renews automatically, monthly or yearly, at the price in force at the time of renewal, until you cancel it.
• Cancellation. You can cancel at any time from the billing section of your account settings. Your plan stays active until the end of the period you have already paid for, and you can reactivate it before then.
• Refunds. If Premium is not for you, write to office@dojocode.io within 14 days of your first payment and we will refund it in full. Otherwise, payments are not refunded for a period that has already started, unless the law requires it.
• Price changes. If we change the price of your plan, we will tell you in advance, and the new price will apply from your next renewal. You can cancel before it takes effect.
• If you stop paying. Nothing is deleted. Your profile, progress, submissions and projects stay, and the features that belong to the paid plan switch off at the end of the paid period.

Nothing in this section limits any right you have as a consumer under the law of the country where you live.

Points, tokens and AI credits

The Service uses points, badges, ranks, DojoCode tokens, coins and AI credits. They can be earned or received through your activity on the Service, through a plan, or in other ways we make available, and they can be used only inside the Service. They have no monetary value, cannot be exchanged for money, and cannot be transferred or sold outside the Service unless we expressly allow it. AI credits that are included in a plan are topped up on the schedule shown for that plan, and unused credits do not carry over. We may change how these items are earned and used.

Contests and hackathons

Contests and hackathons are run under the rules shown for each event, which may be set by us or by the organizer of the event. Rewards are those described for the event. We or the organizer may disqualify a participant, and withhold or withdraw a reward, where there is cheating, plagiarism or another breach of the rules or of these Terms of Service.

Your content

You keep the rights you have in the content you create and submit on DojoCode, such as your solutions, challenges, learning paths, projects, comments and messages. You are responsible for your content, and you must have the right to submit it.

By submitting content to DojoCode, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of operating, improving, and promoting our services. This license will end when you delete your content or your account, unless your content has been shared with others who have not deleted it. Challenges that you have published to the public library, and the solutions you have submitted, stay on the Service after you delete your account, under a non-personally identifiable name.

Some of your content is public. Your profile, your published challenges, your solutions to public challenges and your results in contests and hackathons can be seen by other users.

Projects, publishing and hosted databases

The Service lets you build projects, publish them to a public address and, where available, use a database that we host for the project. A published project can be opened by anyone, and you are responsible for everything it contains and does, including any personal data it collects from its visitors.

You must not use projects, publishing or hosted databases to host or distribute anything unlawful, deceptive or harmful, including malware, phishing pages, content that infringes someone else's rights, or content that imitates another person or organization. You must not use them to send spam, to mine cryptocurrency, to attack or probe other systems, or in a way that places an unreasonable load on our infrastructure.

The number of projects, published applications and the resources available to them depend on your plan. We may unpublish a project, or suspend a database, that breaks these Terms of Service or puts the Service at risk. These features are provided for learning and building, and we do not promise that a published project or a hosted database will always be available or that its data is backed up. Please keep your own copy of anything important.

AI features

The Service includes AI features, such as an assistant that explains errors, gives hints and reviews code, tools that help create challenges, contests and learning paths, voice conversations, and the generation of text, images and other media inside projects.

• Check the output. AI output can be wrong, incomplete or unsuitable. You are responsible for reviewing it before you rely on it or publish it.
• What you send. What you send to the AI features is processed by the AI providers named in our Privacy Policy. Do not send confidential information or personal data about other people.
• Limits. The AI features are subject to credits and usage limits that depend on your plan.
• In a class. A teacher can limit or switch off AI help for a group, and may be able to see how much you used it on a task.
• Acceptable use. You must not use the AI features to produce content that is unlawful, harmful, deceptive or that infringes someone else's rights, or try to get around the safeguards of the AI features.

Live collaboration, voice and video

The Service lets you work with other people in the same editor in real time and take part in voice and video sessions. What you type, say and show in a session can be seen or heard by the other participants. Please treat them with respect, and do not record or share a session without the agreement of the people in it.

Rules of Acceptable Use

In addition to the other requirements within these Terms of Service, this section describes specific rules that apply to your use of the Service (the "Rules of Acceptable Use").

When using the Service you must not:

Give any false or misleading information in your personal details;

Present someone else's work as your own in a task that requires your own work, or upload any content to which you do not have sufficient rights to grant us the rights and licenses specified herein;

Cheat in an assignment, contest or hackathon, or help someone else to do so;

Permit another person to use the Service under your name or on your behalf;

Use the Service if we have suspended or banned you from using it;

Harass, threaten or abuse other users, or submit content that is unlawful, hateful or sexually explicit;

Modify, interfere, intercept, disrupt or hack the Service, or try to access data or accounts that are not yours;

Collect data from the Service by automated means, or use the Service to build a competing product, without our written permission;

Misuse the Service by introducing viruses, Trojans, worms, logic bombs or other material which would harm the Service or any user of the Service's own equipment.

Failure to comply with the Rules of Acceptable Use constitutes a material breach of these Terms of Service, and may result in our taking all or any of the following actions:

Immediate, temporary or permanent withdrawal of your right to use our Service;

Removing content, unpublishing a project or cancelling a result; or

Informing your school or organization.

Confidentiality

Challenges, tests and other content on the Service that are not public, including the content of an assignment, contest or hackathon that has been shared only with its participants, are confidential. You must not publish or share them outside the Service.

Changes to the Service and to these Terms of Service

We keep developing the Service, so we may add, change or remove features. We may also update these Terms of Service. When we make a change that matters to you, we will let you know in advance, for example by email or by a notice on the Service. If you continue to use the Service after the change takes effect, you accept the updated Terms of Service.

Ending our relationship

If at any time you do not feel that you can agree to these Terms of Service or to any changes made to the Terms of Service or the Service which we have made public, you must immediately stop using the Service. You can delete your account at any time from your account settings.

We may end or suspend your use of the Service if you break the Rules of Acceptable Use, any other important rule, or the terms and conditions we set for accessing and using the Service, including these Terms of Service.

If you or we end your use of the Service or we withdraw the Service as described in this section, we may delete or modify your content, or any other information we hold about you. You may also lose any rights you have to use the Service or access our content or your content.

Our liability and our responsibility to you

Unfortunately, due to the nature of the internet and technology, the service is provided on an “as available” and “as is” basis. This means that we cannot guarantee that your use of the service will be uninterrupted, free of delays or errors, or that it will always meet all of your expectations. We make no commitments regarding the performance or availability of the service under these Terms of Service and, to the extent permitted by law, we exclude any commitments that may otherwise be implied. Likewise, we cannot guarantee the accuracy, timeliness, availability, correctness, or completeness of the information contained on the service, although we make all reasonable efforts to achieve this.

You are responsible for your use of the Service.

To the extent permitted by law, we are not responsible for losses that we could not reasonably have foreseen, for loss of data, or for loss of profit, business or opportunity. Where you use the Service for free, we are not responsible for loss or damage you suffer as a result of our breach of these Terms of Service or our negligence. Where you pay for the Service, our total liability to you is limited to the amount you paid us in the twelve months before the event that gave rise to the claim.

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law. Nothing in these Terms of Service affects the rights you have as a consumer under the law of the country where you live.

Governing law

These Terms of Service are governed by the laws of Romania. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and you may bring a claim in the courts of that country.
